DISADVANTAGED / MINORITY BUSINESS ENTERPRISE (DBE / MBE)

The U.S. Department of Transportation has made several revisions to forms and applications used in its Disadvantaged Business Enterprise (DBE) Program in DOT Assisted Programs.

Revisions were also enacted on the following: uniform application and reporting forms; implementing a memorandum of understanding with the Small Business Administration; amendments to provisions concerning personal worth; retainage; size standard; proof of ethnicity; confidentiality; proof of economic disadvantage; DBE credit for trucking firms; eligibility of firms owned by Alaska Native Corporations; clarifications concerning multi-year project goals; and, the use of the new North American Industrial Classification System.

Should I Apply For DBE Certification, MBE Certification, Or Both?

A firm may apply for DBE Certification (to participate as a DBE on USDOT Assisted contracts), for MBE Certification (to participate as an MBE on State-funded contracts), or for both.  The following questions have been developed to help you decide which certification(s) may be right for your firm.  If you have any questions or need clarification, please contact us at mbe@mdot.state.md.us 

  • Is your firm at least 51% owned by a socially and economically disadvantaged individual(s) who also controls the firm?
  • Is the disadvantaged owner a U.S. citizen or lawfully admitted permanent resident of the U.S.?
  • Is your firm a small business that does not exceed either the Small Business Administration’s (SBA’s) size standard or $19.57 million in gross annual receipts?
  • Is your personal net worth less than $750,000.00?  (if your personal net worth exceeds $750,000 but is less than $1,500,000 your firm may apply only for MBE certification) www.e-mdot.com/MBE_Program/MBE%20Certification%20Applications
  • Is your firm organized as a for-profit business?
  • Is your firm at least 51% owned by a member(s) of one or more of the following groups: African American/Black, Female, Asian Pacific, Hispanic, Subcontinent Asian, American Indian/Native American? (if your firm is owned by an Indian Tribe, Native Hawaiian Organization, Alaska Native(s), or Alaska Native Corporation, it may be eligible for DBE certification, but may not be eligible for MBE certification.  Please contact us for further information).                            

If you answered “YES” to all of the questions above, your firm may be eligible to participate as a DBE on USDOT assisted contracts (including those let by the Maryland Aviation Administration, the Maryland Transit Administration, and the State Highway Administration), as well as participate as an MBE on State funded contracts.  If you answered “NO” to certain of the questions above, your firm may still be eligible for MBE certification.
